(CNN) -- A grand jury charged Joseph P. Smith with killing 11-year-old Carlie Brucia, according to an indictment released Friday by the Sarasota County State Attorney's Office.
Carlie's abduction captured national attention after images from a security camera outside a car wash showed her being led away by a man in a blue jumpsuit. She had been walking home from a friend's house February 1.
Her body was found five days later a few miles from the car wash. Smith, 37, also is charged with kidnapping and capital sexual battery on a person younger than 12.
Prosecutors have not said whether they will seek the death penalty for Smith, who is being held without bail at the Manatee County Jail.
Smith's public defender, Adam Tebrugge, told The Associated Press that his client will plead not guilty at his arraignment scheduled for March 12. "We will thoroughly investigate the case and vigorously defend Mr. Joseph Smith," Tebrugge told the AP.
A tip led police to Smith, a former auto mechanic and convicted criminal with 13 arrests on his record.
Authorities found Carlie's body because Smith confided in a jailhouse witness after his arrest, according to a warrant.
The indictment says Carlie died by "means of ligature strangulation."

With some cases I think they should take the person right from the court to the chair or whatever they use. This man was caught on tape and he admitted it so no appeals no 3 meals in jail do not pass go do not collect nothing kiss your mama good bye and be through with it. Then with others where there might be a mistake or two that could have been made let them have 1 appeal and all the dna tests or whatever and if they still are found guilty time to go.
NEVER EVER make someone or anything a priority when you are only an option.

that's what I'm saying. that same chair he's sitting in while formal sentencing is issued should be an electric chair or swing around right into a death chamber.
